U.S. Attorney Andrew Lelling announced the charges against Newton District Court Judge Shelley M. Richmond Joseph on Thursday. Former court Officer Wesley MacGregor was also charged.
The City of Newton in the State of Massachusetts declared itself a sanctuary city in February 2017. The vote passed 16 to 1. Under the ruling, city officials declared (on their own without verifying if the decision was legal or just political) that local police would not help federal officials (such as ICE) detain undocumented illegal aliens.
Unfortunately, declaring that a location will not abide by federal law by converting it to a sanctuary location (be it a town, village or city) is a political decision it is not a legal one. Declaring a City a Sanctuary City is not recognized by federal law. It is a popular way politicians have found that earns them considerable votes. Under the ruling, city officials were stating that local police would not help federal officials detain undocumented immigrants.
